IntelAgility DMCA & Copyright Notice

IntelAgility respects intellectual property rights and expects users of our website and services (https://intelagility.ca) to do the same. This DMCA & Copyright Notice explains how to submit (1) a copyright infringement notice (takedown request) and (2) a counter-notice if you believe content was removed or disabled by mistake.

This notice is intended to comply with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. If you are located outside the United States, you may still use this process, and we will review requests under applicable law.

1) Copyright ownership and permitted use

All original content published by IntelAgility, including frameworks, playbooks, templates, checklists, prompt packs, website copy, graphics, branding, logos, and documentation (collectively, “IntelAgility Materials”), is protected by copyright and other intellectual property laws.

Unless otherwise stated in writing, IntelAgility grants you a limited, revocable, non-transferable license to access and use IntelAgility Materials for your internal, personal, or business use. You may not reproduce, distribute, sell, license, publish, or exploit IntelAgility Materials (or substantial portions of them) without prior written permission from IntelAgility.

2) Reporting copyright infringement (DMCA takedown notice)

If you believe content on the Services infringes your copyright, you may submit a written takedown notice to our designated copyright contact. Your notice must include all of the following:

  1. Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
  2. Identification of the infringing material and information reasonably sufficient to allow us to locate it (for example, a direct URL on our site and screenshots, if available).
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and that, under penalty of perjury, you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your physical or electronic signature (typing your full legal name is generally acceptable as an electronic signature).

If your notice is incomplete, we may be unable to act on it.

3) What happens after we receive a valid notice

Upon receipt of a complete and valid notice, IntelAgility may:

  • remove or disable access to the identified material
  • notify the party who posted the material
  • take other steps consistent with applicable law

IntelAgility may terminate access for repeat infringers where appropriate.

4) Counter-notice process (if you believe removal was a mistake)

If you believe your content was removed or disabled due to mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal (for example, the prior URL).
  2. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, mailing address, telephone number, and email address.
  4. Your physical or electronic signature (typing your full legal name is generally acceptable).

5) Counter-notice consent to jurisdiction and service

If you submit a counter-notice, you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the jurisdiction of a Federal District Court located in the United States where IntelAgility may be found). You also agree to accept service of process from the person who submitted the original takedown notice (or that person’s agent).

6) Misrepresentation warning

Under applicable law (including 17 U.S.C. §512(f)), any person who knowingly materially misrepresents that material is infringing (or that material was removed or disabled by mistake or misidentification) may be subject to liability, including damages, costs, and legal fees.

7) Processing and communication

We review complete notices as soon as reasonably practicable. We may request additional information to verify your claim or to locate the material. All communications regarding copyright complaints should be sent by email to hello@intelagility.ca.

8) Other intellectual property and legal complaints

This DMCA process applies to copyright claims only. If you believe content violates trademark rights, privacy rights, confidentiality rights, or other laws, please contact us at hello@intelagility.ca with details, and we will review the request under the applicable process.

9) Repeat infringer policy

IntelAgility may, in appropriate circumstances and at its discretion, disable or terminate access for users who are repeat infringers.
